Laguna Niguel : Board Won’t Interfere With Shapell Units

The county Board of Supervisors on Tuesday agreed not to interfere with Shapell Industries Inc.’s plans for a 5,200-unit residential development in exchange for early construction of nearby roads.

The supervisors last week had delayed approval of the 10-year pact, the first such development agreement undertaken by the county, to allow for minor changes in wording.

Shapell, a Beverly Hills firm, will build a stretch of Moulton Parkway in Laguna Niguel by June 30, 1989, and will accelerate construction of a portion of Alicia Parkway. The company also pledged not to ask to build more units than are now approved.

The county, which normally can overrule a company’s plans until construction begins, agreed to let the project go ahead as planned, while leaving it to the Planning Commission to approve specific site plans.

The pact can be overturned if Laguna Niguel incorporates as a city, which could happen later this year, but a bill pending in the Legislature would force a new city to abide by pacts entered into by the county.
