A narcotics conspiracy charge against restaurant owner Ramon Vives, one of 13 men indicted in the Phoenix Suns’ drug investigation, was dismissed.

Superior Court Judge Michael Ryan dismissed the charge of conspiracy to traffic narcotics “with prejudice,” meaning it can’t be refiled. Ryan said there was potential for “severe damage” to Vives if the case were left in limbo.

A motion for dismissal was filed last week because Sun player Walter Davis, the state’s key witness, recanted testimony that he and others used cocaine with Vives.
