A New York appeals court refused to block a judge’s precedent-setting order barring lawyers for white youths from excluding solely on race blacks from the jury in the case of an attack on three black men in Howard Beach. One of the black men was chased onto a highway and struck and killed by a car. In a unanimous decision, a four-judge panel of the Appellate Division of State Supreme Court in Brooklyn said they could not rule on state Supreme Court Justice Thomas Demakos’ decision until there is a verdict in the murder-manslaughter trial. The defense has so far used three of its peremptory challenges to dismiss three black prospective jurors.
