James A. Lewis, the 1984 Libertarian Party vice presidential candidate, has been indicted in U.S. District Court for failing to file income tax returns for 1981, 1982 and 1983.

Lewis, 54, of Old Saybrook, Conn., who said he was not aware of the indictment, said he will seek to prove that the federal income tax is illegal because the law does not allow salaries to be taxed. If convicted on all counts, Lewis could be sentenced to three years in prison and fined $60,000.
