Local News in Brief : Garden Grove : Adult Bookstores Score Third Victory in Court

City officials seeking to enforce an ordinance regulating adult bookstores have met with another courtroom defeat, their third straight.

The state Court of Appeal in Santa Ana, in a decision released Tuesday, declined to upset a Superior Court ruling that the ordinance is unconstitutional. The action leaves adult bookstores and arcades free to continue business uninterrupted, according to Roger J. Diamond, lawyer for the stores.

The city is considering an appeal, or a revision of the ordinance to satisfy the court’s concerns, according to Assistant City Atty. William P. McNames.

Adopted in 1983, the Garden Grove ordinance laid down detailed regulations of bookstores and arcades catering to adults. It required special permits, regulated such things as width of aisles in the stores and prohibited doors on peep-show stalls.

The three shops involved in the case are A to Z Books, 8192 Garden Grove Blvd., the Adult Bookstore, 8502 Garden Grove Blvd., and the Hip Pocket, 12686 Garden Grove Blvd.
