The 3rd Circuit Court of Appeals ruled that the failure of National Semiconductor of Santa Clara to fill orders for microchips did not necessarily cost Pittsburgh-based National Controls Corp. profits despite a jury’s verdict last year in favor of NCC. In its lawsuit, NCC said NSC provided only 126 microchips out of 7,300 promised, which prevented it from business with national long-distance telephone company MCI that could have resulted in the sale of as many as 180,000 special telephones. The three-judge appeals panel ruled that NCC failed to prove MCI would have purchased the telephones.
