Ruling on High-Rise Project

Superior Court Judge Miriam Vogel’s ruling allowing a developer to continue his 95-foot-high building in violation of a covenant most certainly will give developers the “go-ahead” to simply ignore legal agreements. The name of the game will be to go forth hurriedly, trusting an impotent or lethargic public and a legal precedent set by the Vogel ruling to gain their financial ends. If, on the other hand, the judge had ruled that the out-of-compliance portion had to be dismantled, it would most certainly send a message to other developers to observe existing agreements or covenants.
