Local News in Brief : News Rack Law Upheld
A judge Wednesday upheld the constitutionality of a Glendale ordinance restricting the number of news racks on city streets, even though it gives preference to large, daily newspapers.
The 1975 ordinance was challenged by a distributor of sexually oriented newspapers who filed suit against the city in January, 1986.
The ordinance limits to eight the number of news racks in any given location, allows no more than 16 racks on any one side of a city block and gives priority to general-circulation newspapers.
An attorney for distributor Paul Duffy argued during a non-jury trial last December that the ordinance is unconstitutional on the grounds that it limits free speech.
However, Glendale Superior Court Judge Joseph Kalin said Duffy did not show that the ordinance is “unreasonably restrictive (of) constitutional guarantees.”
