Dukakis Loses Suit Over Troops
A federal judge today rejected a lawsuit filed by Gov. Michael S. Dukakis aimed at preventing Massachusetts National Guard troops from training in Central America.
U.S. District Judge Robert Keeton, in a lengthy opinion, said federal authorities have the power to give orders to National Guard troops even when a governor objects. Keeton explicitly upheld the constitutionality of the Montgomery Amendment, a 1986 act of Congress that strips governors of the power to decline such assignments unless their states are facing an emergency that requires the Guard.
