The main contractor for the San Jose downtown transit mall project has been charged with embezzling about $200,000 from employee pension and health funds. A federal grand jury issued a 10-count indictment against David Weiss and his Weisscal Co. after an 18-month investigation by federal and local authorities. Weiss and his wife, Judy, both of Palo Alto, also were charged with income tax evasion. Weiss’ lawyer, Charles Breyer, contended the charges amounted to a dispute over the administration of the company’s benefit plans.
