The 9th U.S. Circuit Court of Appeals has refused to reconsider a request by lawyers for Nancy Hoover Hunter to throw out her 234-count fraud indictment on the grounds that the prosecutor who presented the case to a grand jury had not been admitted to the State Bar.

The court rejected the motion last March without comment, but lawyers for Hoover filed a motion to reconsider the issue, and the 18-month-old case has been on hold ever since.

Gay Hugo, the assistant U.S. attorney handling the case, said the decision, which she received Monday, means that the case can now be scheduled for trial.
