Two warring Peace and Freedom Party factions Monday claimed their own spots on California’s November ballot, but a third faction said that no one was legally nominated at the party’s Oakland convention last weekend.

Herb Lewin, 73, of Philadelphia was elected at the convention, but Lenora B. Fulani, 38, of New York claims his delegates are legally unqualified. She says she was nominated in a “parallel convention” in an Oakland motel.

Both claim the nomination in papers filed with Secretary of State March Fong Eu, but Eu aide Tony Miller said independent party members--those not tied to Fulani’s New Alliance Party or Lewin’s Internationalist Workers Party--claim that neither candidate was legally nominated.

Miller said he is investigating and will make a decision by Sept. 1.
