Publishers of sex-oriented newspapers would be forced to post 24-hour guards at news racks in San Bernardino to prevent minors from buying the papers under a law given preliminary approval. But City Atty. James Penman said he would recommend that city leaders rescind the ordinance because it conflicts with state law, which takes precedence. The City Council gave the ordinance initial approval by a 4-2 vote. Penman said he had done further study since making a statement that he believed the law would stand up to constitutional scrutiny. A final council vote is scheduled Oct. 3. If approved, the ordinance would become law in 30 days, barring appeals.
