Dukakis Loses Appeal on Guard

BOSTON —
A federal appeals court today upheld a lower court’s ruling that Gov. Michael S. Dukakis’s Administration lacks legal grounds to stop the Pentagon from sending Massachusetts National Guard units to Central America.
In a one-page decision, the U.S. 1st Circuit Court of Appeals unanimously upheld the “well-reasoned opinion” of U.S. District Judge Robert E. Keeton that the 1986 “Montgomery Amendment” did not illegally strip states of their constitutional right to control deployment of their own militias.
