Dallas billionaire H. Ross Perot has withdrawn a request for a temporary order prohibiting Electronic Data Systems Corp. from interfering with his new data processing company, Perot Systems. With the action, Perot dropped part of his countersuit to a claim filed by EDS, which argued that by founding the new firm, Perot was violating a non-competition clause in the agreement he signed when he left EDS. In a hearing last week on EDS’s suit, a Virginia judge ruled that Perot Systems does not violate the agreement as long as it is operated on a nonprofit basis until December, 1989. Fletcher Yarbrough, Perot’s attorney, said the ruling negated the need to seek the preliminary injunction.
