A federal appeals court cleared the way for a new trial to begin next week in the GAF Corp. stock manipulation case. The U.S. 2nd Circuit Court of Appeals turned down a defense request to delay the trial and hear arguments on whether the case should be permanently dismissed. The original trial ended in a mistrial Tuesday because a federal prosecutor had delayed turning over a piece of evidence to the defense. Appeals Court Judge Roger J. Miner said there wasn’t any indication that the prosecutor had deliberately withheld the report. But he told Assistant U.S. Atty. Carl H. Loewenson Jr.: “See to it, Mr. Loewenson, that you don’t withhold any more evidence.”
