Ousted Philippine President Ferdinand E. Marcos is “dying” and charges against him and his wife of looting their homeland and defrauding U.S. banks should be dropped, his lawyer said today.

At a hearing before U.S. District Judge John F. Keenan, Richard Hibey, attorney for Marcos, 71, requested the charges be dismissed because of his “rapidly deteriorating physical condition.”

Keenan made no decision during the brief proceedings and scheduled another hearing for Thursday.

Marcos is in guarded condition at St. Francis Medical Center in Honolulu. He was admitted Sunday for treatment for pneumonia in his left lung and bronchial asthma. He initially was placed in intensive care and then moved to regular accommodations.
