A spokesman for Robert Abrams, New York state attorney general, said Abrams would appeal the March 28 decision that took the America’s Cup from the San Diego Yacht Club and awarded it to New Zealand.

State Supreme Court Justice Carmen Ciparick ruled the race between the catamaran Stars and Stripes and New Zealand banker Michael Fay’s 133-foot sloop a “gross mismatch” in ordering San Diego to forfeit the cup.

Dave Fishlow, a spokesman for Abrams, said New York did not believe the race was a mismatch or that the Deed of Gift barred catamarans from racing against yachts. But even if it did, he said, Ciparick should have ordered a new race, not a forfeit.

The San Diego Yacht Club is also appealing the decision. The two appeals will be joined in a suit to be filed with the Appellate Division of New York Supreme Court.
