No-Fault Auto Insurance
I agree with you that we badly need a good “no-fault” law like New York has. We don’t for the reasons you mentioned. Our state government has been captured by two powerful lobbies, the insurance industry and the bar association, who insist on getting their “cut” before the public gets a square deal.
How to cut through this? We have already begun. Thanks to Proposition 103, next year we will have an elected insurance commissioner (for the first time, effective public regulation of insurance rates!). The next step should be to limit the right to sue.
The trial lawyers say that limiting this right will injure the public. Not true! The public doesn’t benefit from endless, costly litigation. Is it true that we need a contingency fee system to get maximum benefit from each insurance dollar? Not at all. New York proves otherwise.
