Don Nay, director of the San Diego Unified Port District, will decide today whether to levy a $1,000 fine against US Air for allegedly violating the after-hours curfew at Lindbergh Field, a spokesman for the Port District said.

Because of noise, no departures are permitted at the San Diego airport from 11:30 p.m. to 6:30 a.m. The flight in question--US Air 620--left San Diego at 11:57 p.m. on Aug. 4, bound for Pittsburgh.

Larry Pickett, a spokesman for the airline, said the time of departure has not been disputed.

“We had a lot of activity that night, because we had just merged with Piedmont Airlines,” Pickett said.

Port District spokesman Dan Wilkens said that Nay spent much of the day on Monday reviewing the documentation provided by US Air. He said $1,000 is the fine for a first offense; $3,000 for a second offense, and $5,000 for a third, followed by a review of the airline’s operating privilege at Lindbergh.

“Potentially, an airline such as this could suffer the loss of their flying privilege into and out of San Diego, so it isn’t to be taken lightly,” Wilkins said.
