From Times Staff and Wire Reports

A state appeals court upheld a judge’s decision to seat a black juror, allowing the trial of a policeman who shot and killed a black motorcyclist to resume in Miami. The trial of William Lozano stalled when the defense targeted the juror for a peremptory challenge. The trial judge ruled the action was based on race, and therefore illegal. The 3rd District Court of Appeal agreed. Lozano is charged with two counts of manslaughter in the Jan. 16 deaths of the motorcyclist and his passenger. The deaths set off three days of racial violence.
