Burglary Term for Accused Killer
A Clairemont man awaiting a retrial on a murder charge in the killing of his mother-in-law in a doughnut shop was sentenced Wednesday to seven years in state prison for burglarizing his estranged wife’s house after the shooting.
Randy Geering, 36, was given the term by San Diego Superior Court Judge William Kennedy, who also imposed a $300 fine.
The jury in Geering’s first trial deadlocked 11 to 1 on Nov. 15 for conviction on the murder charge in the Jan. 29 death of Audrey Erbe, 59, who was shot in the head at the Winchell’s Donut Shop on Balboa Avenue.
The jury did convict Geering of burglarizing the house of his estranged wife, Dianna Geering, and of exhibiting a weapon in a threatening manner in the doughnut shop.
Geering is set for retrial on the murder charge Jan. 5.
Dianna Geering testified that her former husband entered the doughnut shop, where Erbe was the manager, and she overheard a loud argument between him and her mother while she hid in another room. Then, she said, she heard a shot.
