With the appointment of Assistant U.S. Atty. Nancy Wieben Stock to the Orange County Superior Court, the bank-fraud trial of Janet Faye McKinzie is being delayed to Wednesday in U.S. District Court in Santa Ana.

Wieben Stock is being replaced in the McKinzie trial by Assistant U.S. Attys. Paul L. Seave and David J. Schindler.

McKinzie is charged with 40 counts of bank fraud, conspiracy and racketeering, and could receive more than 200 years in prison if convicted on all counts for her role in the 1987 failure of North America Savings & Loan in Santa Ana. The thrift was eventually shut down, costing taxpayers $120 million.

Wieben Stock was appointed a Superior Court judge by Gov. George Deukmejian about two weeks into the McKinzie trial. She was sworn in Jan. 26, only three days before the filing period opened for candidates interested in running for her Superior Court post in June.

Deukmejian spokesman Susan Trowbridge said the governor wanted Wieben Stock sworn in before the filing deadline so she could run as an incumbent. Legal insiders said that will strengthen her position against other candidates.
