CRA, City, Developer Held Liable for Condo Damage

A judge ruled this week that the Los Angeles Community Redevelopment Agency, the city of Los Angeles and a development company are liable for millions of dollars in damage to two sections of the troubled Monterey Hills condominium project.

The tentative ruling by Los Angeles Superior Court Judge Eli Chernow ended the nearly two-year trial of a suit brought by owners of Eaton Crest, a section of the 1,611-unit CRA project. A jury decided in April, 1989, that 164 owners of Eaton Crest suffered $9.9 million in damage to their homes from soil subsidence. Chernow also included in his ruling 122 owners of the Temple Terrace section, where losses have yet to be set.

Chernow ordered a series of settlement conferences before he issues his final ruling on April 16. Another group of purchasers of the low-cost condominiums has been paid a $6.6-million judgment. Seven other lawsuits are pending.
