Court OKs Tax Hikes by Judges
Does our Supreme Court remember that the American Revolution was fought under the banner of no taxation without representation? The justices have no more right to impose taxes on us than did George III (“Court Lets Judges Order Tax Hikes,” Part A, April 19). What kind of tea must be dumped in what harbor to make our point anew? Our justices seem also to have forgotten Chief Justice John Marshall’s admonition in McCulloch vs. Maryland that the power to tax involves the power to destroy. Ends do not justify means. Taxation, even in the guise of a shell game such as Missouri vs. Jenkins, remains taxation.
Article I, Section 8 of the Constitution tells us that only Congress shall have the power to levy and collect taxes. How much more explicit can you get than that?
