Court Rulings on Ollie North Convictions

It is not surprising that the two conservative judges appointed to the U.S. Court of Appeals by Ronald Reagan voided the North verdict on a narrow technicality and the chief judge appointed by Jimmy Carter dissented.
The question is why North being an active Marine at the time of the Iran-Contra affair was not court-martialed and sentenced by a military tribunal? He did commit several illegal acts, like executing illegal orders of his superiors, which are punishable offenses according to the military code.
Is a soldier in the personal service of the President permitted to commit crimes with impunity?
