SIMI VALLEY : Man Gets Probation in News-Rack Case

A Simi Valley sanitation supervisor was sentenced Thursday to three years probation for improperly dispensing sexually explicit newspapers through a vending machine.

Arthur Fishel received the sentence and $500 in fines and penalties from Municipal Judge Bruce A. Clark, who had convicted him Nov. 8 in a non-jury trial. Clark found Fishel guilty of failing to put a blinder in the news rack window to cover the bottom two-thirds of a copy of the paper L.A. X . . . Press, as required for all vendors of sexually explicit material.

Fishel was also found guilty of failing to buy a city permit for the news rack, which was located in the 2500 block of Galena Avenue, in front of the Simi Valley post office, said Stephen L. Millich, an assistant city attorney.

Fishel has said the ordinances violated his right to free speech.
