A summary of Southern California-related business litigation developments during the past week.
Buick Radio Ad: The owners of Consumer Reports magazine filed a false advertising suit against Multi-Media Marketing Communications Inc. and Southern California Buick Dealers Assn. for allegedly running a radio ad that falsely asserted that Consumer Reports gave the 1990 Regal a favorable rating. In the federal suit, Consumers Union asserted that it “never tested or rated the 1990 Buick Regal” and said the radio commercial was “materially false, inaccurate, deceptive and misleading. “ In the radio ad, a satisfied customer named Fred extols the Regal’s features and says “Consumer Reports gives it a very good rating.” The suit, which also alleged misuse of trademark, seeks at least $1.5 million in damages.
