Insurers’ Suit to Block Rate Rollbacks Dismissed
The state Court of Appeal in Los Angeles dismissed a lawsuit by more than 80 auto insurance companies seeking to block Insurance Commissioner John Garamendi from revising his predecessor’s standards for Proposition 103 insurance rate rollbacks and rebates.
Garamendi hailed the decision as a victory for consumers. The dismissal, which in effect upholds a Los Angeles Superior Court decision, means that Garamendi is free to issue his own standards after abbreviated hearings and order rebates of portions of 1989 premiums. Former Insurance Commissioner Roxani Gillespie has issued the earlier standards.
