OXNARD : Rape Victim Files $1-Million Claim

An Oxnard teen-ager who was raped by three youths on New Year’s Eve has filed a claim against Ventura County, seeking compensation for distress she said she suffered from a remark made by an investigating sheriff’s deputy.

In the claim, which seeks $1 million, the 16-year-old girl contends that Deputy Raymond Bornand failed to gather all the evidence, and on the way to the crime scene said: “There goes my New Year’s Eve.”

Three teen-agers were arrested and convicted in the crime, Sgt. John Fitzgerald said. He said two were sentenced to the California Youth Authority, and the third was tried as an adult and sent to jail.

He said the mother of one of the rapists bought liquor for all four teen-agers before the rape occurred at Rio Del Valle School in Oxnard.

The victim’s mother and sister also filed claims against the county for $100,000 each, saying they also suffered emotional distress from the deputy’s comment. The claims are required before a suit can be filed against a public agency.

Fitzgerald said the claim is not proof that Bornand made such a remark. But he added that it would be inappropriate for any deputy to make such a comment to a crime victim.
