Supreme Court on Nude Dancing

No matter how one feels about nude dancing, I don’t see how anyone could help but be alarmed at the phrasing of the court’s decision.

The article said that “the conservative justices said they are not willing to read the Constitution broadly to protect expressive conduct that offends the majority.”

Maybe Rehnquist, et al., ought to be given a refresher course in American constitutional theory. It is just such threatening forms of expression, like Robert Mapplethorpe and 2 Live Crew, that the framers of the Constitution sought to protect.

In the last six months, we went through a time when those who protested the war in the Persian Gulf certainly “offended the majority.” Using the same logic, it is constitutional to ban such protests, too.
