Nation IN BRIEF : NEW YORK : Court Upholds Dial-a-Porn Limits

The U.S. Court of Appeals for the 2nd Circuit in New York upheld a law forbidding the sale of dial-a-porn telephone services to anyone under 18. Last year, a federal district court issued an injunction blocking enforcement of the 1989 Helms Amendment after ruling it unconstitutional because it was too vague and was a prior restraint on free speech. A three-member panel of the appeals court disagreed and found that “indecent” as used in the amendment had been defined by the Federal Communication Commission.
