William Kennedy Smith’s attorneys said they will not appeal, for now, the release of new pretrial witness statements sought by reporters. Lead attorney Roy Black wrote West Palm Beach, Fla., Circuit Judge Mary Lupo, telling her defense attorneys “do not wish to unnecessarily delay the trial proceedings” with an appeal. Smith, the nephew of Sen. Edward M. Kennedy (D-Mass.) faces trial Jan. 13 on a Florida woman’s claim that he raped her at his family’s estate.
