STANTON : New Adult Business Ban Is Extended

The City Council has extended a moratorium on new adult businesses pending the review of “inadequate” and outdated city enforcement codes that regulate them, City Clerk Darleen Cordova said Wednesday.

The council voted unanimously at its regular meeting Tuesday to extend the ban on new adult businesses until September, 1992.

According to the ordinance, the temporary ban is necessary because the codes are “inadequate” and fail to address problems associated with such businesses, including increased crime, a higher incidence of sexually transmitted diseases and decreased property values. The moratorium was approved as an “urgency” ordinance in September and went into effect immediately rather than after the usual 30 days.

City Atty. Thomas W. Allen said the moratorium also includes an appeals process that will allow new adult businesses to open provided they meet various city land-use requirements.

“The city is essentially trying to balance the obligations imposed on it by the Supreme Court” with regard to First Amendment Rights and the obligation to protect the welfare of residents, he said.

The city has hired Freilich, Stone, Leitner & Carlisle, a Los Angeles-based consulting firm, to review the codes and suggest revisions, according to a written report to the council from Planning Manager Mark Lloyd.
