SAN DIEGO : Suit Against Store Settled Out of Court
The parent company of a grocery store chain operating in San Diego and Riverside counties agreed Tuesday to pay a $90,000 settlement to avoid litigation, after being accused of improper packaging and labeling.
San Diego City Atty. John W. Witt and Riverside County Dist. Atty. Grover C. Trask announced the settlement with Megafoods Stores Inc., which is based in Arizona and has branches in Temecula and San Diego.
The city of San Diego and Riverside County are named as plaintiffs in a civil complaint filed in San Diego Superior Court.
The settlement includes an injunction to cease improper business practices, Deputy City Atty. Tricia Johnson said. The settlement was not an admission of wrongdoing, she said.
County Department of Agriculture officials in Riverside and San Diego conducted a seven-month investigation into overcharging, “short weighing” or using inaccurate scales, and “scanner violations,” in which a price recorded by laser scanners allegedly exceeded the advertised or marked price.
