JAMUL : Prosecutors Will Seek Death Penalty

Prosecutors announced Tuesday that they will seek the death penalty against two men accused of killing a Jamul couple so they could steal a large quantity of marijuana.

During a short hearing in Superior Court, Jorge E. Alvarado, 39, of El Cajon and Jaime A. Hoyos, 34, of Tijuana pleaded not guilty to two counts of murder and other charges.

Deputy Dist. Atty. David Greenberg said he has filed special circumstance allegations against the two men and will ask a jury to recommend the death penalty if they are convicted.

Daniel and Mary Magoon were shot to death May 26 in their heavily secured home on Steele Canyon Road. Alvarado and Hoyos were arrested about one hour later when police recovered 28 pounds of marijuana in the car they were driving.

Prosecutors say Alvarado and Hoyos stole the marijuana from the Magoons. The only witnesses to the murders are the Magoons’ sons--a 9-year-old and a 3-year-old who was shot in the back of the head.

Alvarado and Hoyos will be held without bail pending their next court appearance Dec. 22.
