Ex-Deputy Won’t Be Charged in Sex Case : Inquiry: Assistant D.A. calls Long Beach woman’s accusation of assault ‘a case of one on one’ without corroborative evidence of force. Officer was on duty.

The district attorney’s office will not file charges against a former veteran sheriff’s deputy accused by a Long Beach woman of sexually assaulting her behind a Cypress department store, officials announced Friday.

“This is a case of one on one, and there was no corroborative evidence to prove (sexual assault),” said Debbie Lloyd, the assistant district attorney who reviewed the case. “There is a question as to whether he forced sexual advances on her,” Lloyd added.

The 39-year-old deputy, whose name was withheld by authorities, resigned Sept. 11, a week after the alleged assault, authorities said. He refused to talk to Cypress investigators about the allegations, Police Capt. Bob Krauss said.

Meanwhile, internal affairs officials with the Sheriff’s Department, who have been conducting a separate probe of the woman’s allegation, are continuing with their investigation “as a matter of policy,” said Sheriff’s Lt. Dick Olson.

A pair of Cypress police lieutenants began an investigation into the allegations hours after the woman reported the incident, and forwarded their findings last week to the district attorney’s office, Krauss said.

The alleged assault happened a little more than an hour after the on-duty sheriff’s deputy approached a 22-year-old woman in the Denny’s restaurant in Stanton as she sat talking with friends, the woman told Cypress police and the district attorney’s office.

After talking for about 15 minutes, the deputy and the woman left the Beach Boulevard restaurant in separate cars, Lloyd said. The deputy intentionally pulled the woman over a short distance from the restaurant and asked if she was tired and if she would follow him, Lloyd said.

After responding to a call, the deputy stopped at Cerritos Avenue and Knott Street, where he met the woman, Lloyd said. They talked for about half an hour and kissed, Lloyd said.

The deputy then responded to another call before he met with the woman again about 4:20 a.m. behind a Target department store at Katella Avenue and Knott Street, Lloyd said. The deputy then sexually assaulted her, the woman told investigators.

He was relieved of duty and placed on paid leave on Sept. 3, sheriff’s officials said. The deputy, who had been with the department more than 10 years, resigned eight days later without explanation.
