VAN NUYS : Bernson Targets Airport Regulation

Los Angeles City Councilman Hal Bernson introduced a motion Friday to overturn an anti-jet noise regulation for Van Nuys Airport adopted last week by the city Airport Commission.

But authorities said later Friday that Bernson’s motion is unnecessary and the council need not overturn the regulation to block its enforcement. Rather, the council need only to refuse--at some later date--to adopt an ordinance incorporating the provisions of the noise regulation, which proposes to phase out the noisiest jets over a six-year period.

Without such an ordinance, the regulation is unenforceable, Assistant City Atty. Jerome Montgomery said. Only the council can adopt an ordinance.

Under the proposal adopted by the commission, 43 of the approximately 100 jet aircraft now based at Van Nuys would be banned from using the airport because of the noise they generate. Bernson praised parts of the proposal but objected to the phaseout of the noisy jets.

Neither Bernson nor his staff could be reached for comment on the city attorney’s assessment of his motion.
