A rape defendant testified in Austin, Tex., that a woman’s request for him to use a condom proved she wanted to have sex, even though he had walked into the stranger’s home uninvited and confronted her with a knife. “We were making love after that,” Joel Valdez said. Valdez took the stand in a case that had prompted protests from women’s groups and his accuser when a grand jury declined to indict him. Prosecutors presented the case to a second grand jury, which indicted Valdez in October. Valdez, 28, could be sentenced to life in prison if convicted of sexual assault and burglary.
