Cancer Delays Sentencing for Nesler
Sentencing for a woman who fatally shot her son’s alleged molester in a courtroom was delayed so she can undergo treatment for breast cancer.
Prosecutors agreed Thursday with a defense request to put off Friday’s scheduled sentencing for two months because Ellie Nesler’s illness was diagnosed as cancer earlier last week.
“It was gracious of them not to object,” defense attorney J. Tony Sera said.
Nesler, 41, was convicted of voluntary manslaughter in the death of Daniel Mark Driver, 35. He was shot as he sat shackled at a hearing to decide whether he should stand trial on charges of molesting four young boys, including Nesler’s son.
Prosecutors recommended a maximum 16-year sentence for Nesler, urging the court to send a message that violent revenge can’t be tolerated.
