Waste Incinerator Cleared to Operate by Federal Court

CINCINNATI — A federal appeals court on Friday cleared the way for an Ohio hazardous-waste incinerator to continue limited operations until it obtains final commercial use permits.
The U.S. 6th Circuit Court of Appeals reversed a ruling that required Waste Technologies Industries to shut down after a springtime trial burn.
Full commercial operation for the incinerator in East Liverpool requires a final permit from the federal Environmental Protection Agency, which must first review trial burn data. Such reviews can take a year.
East Liverpool is an Ohio River town of 13,600 residents near the West Virginia and Pennsylvania lines.
