A federal judge Monday denied former state Sen. Frank Hill’s request to remain free on bail pending the appeal of his conviction for taking a $2,500 payoff from an FBI undercover agent.

U.S. District Judge Edward Garcia ordered Hill, 40, to surrender to federal authorities by Oct. 12. Hill’s attorneys argued that the former lawmaker’s conviction should be reversed because he was set up by a key witness seeking leniency from the prosecution. But Garcia disagreed.

“I am not convinced that the appeal is not for the purpose of delay,” Garcia said.

Hill was sentenced Sept. 12 to 46 months in prison and fined $2,650. He was convicted June 16 of extortion, conspiracy and money laundering in connection with the payoff.
