Capistrano District Sues Water Supplier
The Capistrano Beach Water District has sued its supplier for adopting rates to pay for things that won’t benefit Capistrano’s customers.
The lawsuit, filed Tuesday in Orange County Superior Court, alleges that Tri-Cities Municipal Water District’s new rates unfairly charge Capistrano for the cost of such things as capital improvements and feasibility studies.
The Capistrano water district is seeking a declaration that such rates and other charges are invalid, along with a refund of all the money paid to Tri-Cities since July 1.
Capistrano relies on Tri-Cities, a wholesale distributor of water, for its entire supply. Tri-Cities receives its water from the Metropolitan Water District and the Coastal Municipal Water District.
