MOORPARK : $1.1 Million Granted to Injured Worker
A former Moorpark man has been awarded $1.1 million for injuries he received while working on a construction project at the city’s high school.
Kirk Busch, 43, injured his back and almost drowned Feb. 10, 1992, when the service road on which he was driving collapsed in heavy rain and he was washed into the Arroyo Simi, said his lawyer, Peter Goldenring.
Flooding and mudslides from the same storm claimed seven lives in Southern California. Busch underwent back surgery and is permanently disabled because of the accident, Goldenring said.
Busch initially sued the Moorpark School District along with Turf Construction Co., which was installing storm drains for the district’s high school.
The school district was indemnified against liability and did not have to pay any money. School district officials declined to comment on the suit and lawyers for Turf Construction did not return phone calls.
The case originally was filed in September, 1992, and set to go to trial this December.
The settlement negotiations, completed this month, were overseen by retired Ventura Superior Court Judge Robert Soares.
