Judge Refuses to Dismiss Indictment of Schabarum

A judge refused Friday to throw out the indictment of former Los Angeles County Supervisor Peter F. Schabarum on charges he embezzled money from a charity group he headed, rejecting the defense’s claim that the prosecution has not presented an adequate case.

Superior Court Judge Charles E. Horan set an April 28 pretrial hearing date for Schabarum, a longtime conservative and champion of term limits for elected officials.

Horan rejected a defense lawyer’s contention that the criminal statute of limitations had passed on several of the accusations against Schabarum. The former supervisor is alleged to have laundered more than $50,000 in campaign money through a series of nonprofit foundations after his 1991 retirement. Horan also said there was no merit to Schabarum’s lawyer’s contention that the charges were too vague.
