Request to Subdivide Property Is Denied

After his neighbors complained about unstable ground beneath their homes, homeowner John Collins was told he could not subdivide his property.
The City Council this week voted 3 to 2 to uphold a Planning Commission ruling opposing the subdivision. Officials said the property, at 841 Madera Place, sits on a slope of questionable stability.
Collins, who said he is having financial problems, wanted to split his 1.25-acre parcel so that he could build a second home on the land to generate income.
His plan would have met zoning requirements for that area. But the proposal raised questions about whether the project posed a safety and fire hazard.
Neighbors also opposed the subdivision because it would not have been in character with the rest of the neighborhood.
“The character of this lot is such that I don’t think it should be split,” Mayor Don Bankhead said, adding that emergency vehicles would have had difficulty getting to the second home.
