The city filed suit Wednesday seeking to overturn Seal Beach’s approval of the controversial Bixby Ranch development, opposed by residents of Los Alamitos, Rossmoor and Seal Beach because of traffic concerns. The lawsuit, filed in Orange County Superior Court, claims that the Seal Beach City Council violated environmental laws last month when it altered the project at the last minute, substituting 75 houses for a 3,500-seat church, without sufficiently studying the environmental impacts, Los Alamitos City Atty. Thomas W. Allen said.
The suit asks Seal Beach to stop the project and prepare a new environmental impact report, which would mean a new round of public hearings and vote on the altered project, Allen said.
“They essentially changed the project, literally on the night the approval was granted,” he said. “Our position is that the EIR did not adequately address that precise project.”
