Insurer Says Lawyer Is Wrong

* A story Dec. 12, “Jury Finds Insurer Failed Motorist, Awards $181,000,” contains gross misrepresentations of facts regarding the jury’s findings and evidence admitted during the trial.

The jury was unanimous in finding that USAA Insurance Co. properly canceled Joshua Hoy’s policy for nonpayment of premium.

This is contrary to the blatantly false statement by Lee A. Wood, Hoy’s attorney, that his client had paid the premium, given notice of a change of address and was never notified that his policy had been canceled.

In addition, it is ludicrous for Wood to say that USAA has “a policy of refusing to pay judgments even when ordered to do so by a court.” This is absolutely false, and, contrary to Wood’s statement, no evidence supporting that claim was ever introduced during the trial.
