A federal judge has refused to dismiss a lawsuit by Caldera Inc. that alleges Microsoft Corp. engaged in unfair business practices. Orem, Utah-based Caldera alleges that Microsoft built technical glitches into its Windows software to keep it from working on the operating system developed by Novell. Caldera bought the system in 1996. U.S. District Judge Dee Benson scheduled a trial to begin Jan. 17. Caldera is seeking unspecified damages. Microsoft attorney Jim Jardine has said the total damages could reach $1.6 billion.
