Tears of relief rolled down Alisa Ross’ face Wednesday when the defense rested, ending three weeks of deliberation in a case that pits the homeowner against the Turtle Rock Park and Recreation Assn. over the use of the community’s swimming pool.

“I feel really good,” she said. “I can live with the judge’s decision; I can respect his decision. I’m just really glad it’s over.”

Ross sued the association in June, alleging that the Sharks, an Irvine Swim League youth team, monopolize the community pool by holding practices four times a week and swim meets during the summer.

The suit seeks to protect homeowners from liability should a team member be injured and to allow swimmers who don’t belong to the Sharks to use the pool.

Orange County Superior Court Judge Mason L. Fenton gave Ross’ attorney, Alexandria Phillips, five working days to submit a written closing remark. The association’s lawyer will also have five days to draft a closing argument. Phillips will then have an additional five days to offer a rebuttal before Fenton hands down a verdict.
